HB 849 – Health Care Practitioner Transparency Act

Bill Summary
This bill would require health practitioners to wear identification notifying the patient of the practitioner’s appropriate licensure.
The bill states that identification and advertisements must not contain any deceptive or misleading information.
The bill states that badges must include the following:
- Recent photograph
- Name
- Type of license
- Expiration date of license
The bill states that the badge must be worn in a visible manner to the patient.
The bill states that a health practitioner shall display in the practitioner’s office the type of license, certification, registration held by the practitioner.
The bill states that a health practitioner shall not make a a representation about the practitioner’s license, certification, or registration that is misleading.
The bill states that a practitioner operating in more than one setting would be required to comply with this Article in each practice setting.
The bill states that any supervising physician shall post a schedule of the regular hours when the supervising physician will be present in that office.
The bill states that health practitioner who work in a nonpatient setting would not be subject to this Article.
The bill states that any health practitioner who violates this article shall be guilty of unprofessional conduct and may be suvject to disciplinary action.
Any person who is injured or suffers damages as a result of a violation may maintain action in the Wake County Superior Court for injunctive relief against the practitioner who violated this Article.
